Mediatized judiciary: norm (fundamental rights) versus social experimentation

Abstract We propose a study of judicial practice in society undergoing mediatization. noticed that the way procedural actors behave, context where institutions are crossed by mediatization logics, tensions instituted. Social experimentation pressures norm (and fundamental rights). In this context, we consider it productive to make methodological reflections on how research within legal-communicational interface. After contextualizing present moment (judicial activism) mobilizing concept mediatization, used interactional devices investigate two empirical objects selected for cases. The first, dispute over position cameras testimony former President Lula before ex-judge Sérgio Moro. second, debate about meaning being journalist, mediated process blogger Eduardo Guimarães. both cases notice phenomena activism and judicialization becoming more complex perceive right due constitutional guarantee secrecy source strained experiments go beyond canonical legal putting at risk indispensable rights Democratic State Law.
